1. Our Community & Your Account

Atomicempire Outlet is a home for collectors of card games, comics, and related accessories. To place an order, you may need to create an account.

1.1 Account Responsibilities

• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account password and for all activities under your account.
• You must notify us immediately at [email protected] of any unauthorized use of your account.
• You must be of legal age in your jurisdiction to form a binding contract, or have consent from a parent or guardian.

2. Products & Services Description

We specialize in curated collectibles for the discerning enthusiast. Our offerings include:

• Card Singles: Individual cards sold in specified conditions (e.g., Near Mint, Lightly Played). Condition is paramount and described per industry standards.
• Sealed Products: Booster packs, boxes, and starter decks for CCGs and Collectible Card Games.
• Accessories & Storage: Sleeves, deck boxes, binders, and other supplies to protect and organize collections.
• Comics & Related Items: A selection of comics and collectibles.

We strive for accurate descriptions, images, and condition grading. Minor variations in color or print do not constitute a defect. For Card Singles, the condition grade provided at purchase is binding.

3. Orders & Payment Terms

3.1 Order Process

Placing an item in your cart does not reserve it. An order is only confirmed once we send an order confirmation email after payment processing.

3.2 Pricing & Availability

All prices are in US Dollars (USD). We reserve the right to correct pricing errors at any time. Product availability is not guaranteed until order confirmation. We may cancel any order for reasons including, but not limited to, product unavailability, pricing errors, or suspected fraudulent activity.

3.3 Accepted Payment Methods

We accept Visa, MasterCard, JCB, and PayPal. Payment is processed securely at checkout. Your card is charged at the time of order placement.

3.4 Sales Region

We ship globally but cannot ship to certain remote regions or parts of Asia. It is your responsibility to ensure your shipping address is within our serviceable region at the time of order.

4. Shipping & Delivery

Your collection’s journey is handled with the same care we’d want for our own.

• Processing: Orders are packed and prepared within 1-2 business days after payment confirmation.
• Methods:
  • Standard Shipping ($12.95 flat rate): Via DHL or FedEx. Estimated delivery 10-15 business days after shipment.
  • Free Shipping (Orders over $50.00): Via EMS. Estimated delivery 15-25 business days after shipment.
• Delivery Estimates: Are estimates only. Delays may occur due to customs, holidays, or carrier issues. Tracking information is provided upon shipment.
• Import Duties & Taxes: You are responsible for any import duties, taxes, or customs clearance fees levied by your country. We cannot predict or control these charges.

5. Returns, Exchanges & Refunds

Our full Shipping & Returns Policy is incorporated into these Terms. Key terms are summarized below.

5.1 Eligibility Window

You must initiate a return request within 15 days of receiving your shipment.

5.2 Condition for Return

Items must be in original, unplayed, unaltered condition with all packaging. For Card Singles, this means in the exact condition and sleeve as shipped.

5.3 Process

1. Email [email protected] within 15 days with your request.
2. Await an RMA number and instructions. Do not ship without an RMA.
3. Securely package the item(s) and ship to the provided address. Return shipping costs are the customer’s responsibility unless the error is ours.
4. We inspect the return and notify you of the resolution (refund or exchange) within approximately 5 business days of receipt.

5.4 Final Sale Items

The following cannot be returned or exchanged unless they arrive demonstrably damaged or incorrect:

• Opened or used Card Singles (removed from original shipping sleeve/played with).
• Opened sealed product (booster packs, boxes, starter decks).
• Personalized, altered, or signed items (unless sold as such).
• Redeemed digital items or codes.
• Clearance or “As-Is” marked items.

5.5 Refunds

Approved refunds are processed to the original payment method within 5-7 business days. Bank processing may take an additional 3-10 business days.

6. Intellectual Property

The Atomicempire Outlet name, logo, website design, content, and all product imagery are our property or used under license and are protected by copyright and trademark laws. You may not use, reproduce, or distribute any site content without our express written permission. The games, characters, and intellectual property depicted in the products we sell are the property of their respective publishers and are used for identification purposes only. We are an independent retailer and are not affiliated with or endorsed by those publishers unless explicitly stated.

7. User Obligations & Prohibited Conduct

By using our site, you agree:

• Not to use the site for any unlawful purpose.
• Not to attempt to gain unauthorized access to any part of the site, other accounts, or our systems.
• Not to interfere with or disrupt the site’s security or functionality.
• Not to provide false or misleading information.
• To comply with all applicable local, state, national, and international laws regarding your use of the site and purchase of goods.

8. Limitation of Liability

Atomicempire Outlet and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of, or inability to access or use, the site or products, including any damages for lost profits, data, or damage to other collectibles, even if advised of the possibility of such damages.

Our total liability for any claim arising from your order, regardless of the form of action, shall be limited to the purchase price you paid for the specific product(s) giving rise to the claim.

This limitation does not apply to liability for death or personal injury caused by our negligence, fraud, or any other liability which cannot be limited or excluded by applicable law.

9. General Provisions

9.1 Changes to Terms

We reserve the right to update these Terms at any time. The latest version will be posted on our website with an updated “Last Updated” date. Your continued use of the site after changes constitutes acceptance.

9.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, USA, without regard to its conflict of law provisions.

9.3 Dispute Resolution

Any disputes shall first be attempted to be resolved through good-faith negotiation via our customer service. If unresolved, the parties agree to submit to the exclusive jurisdiction of the state and federal courts located in Davidson County, Tennessee.

9.4 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
